DV-stay on proceedings

Wife filed for DV after 5yrs of marriage for maintainance while 498a which is filed before 3.5 yrs ago is almost in trial stage and for sure will be dismissed in another 3 months.Iam planning to go for a stay on proceedings to high court ,as she is qualified as an engineer and capable of earning 50k per month with her previois work exp as a software eng and now she has intentionally resigned her job for getting the maintainance under DV. 1.What are the chances of getting stay if i prove that she is qualified and have work experience? 2.How much time it takes to give stay order after the petition is filed?

Stay you will get, provided you submit to HC all the documentary evidence like degree certificate, her bank statement, her payslips etc.

2.How much time it takes to give stay order after the petition is filed?

The day it is posted for hearing, same day ordrers will be passed.

If the DV case is false one, then no need to worry about paying her maintenance etc.  Only if domestic violence has occured, only then, relief is given,  No domestic violence = no relief to your wife.
