Divorce

Dear Sir,

I married in 2010 and applied for divorce on Nov. 2011. On Nov 2012 my spouse ready for divorce on the ground of mutual consent after receiving the  lumsump amount. (which was paid through demand draft). Now she did not come in last date (Dec-2012). Now if she will not come in further date is it possible that court will issue divorce Ex parte. If not then what are the other options for me.

1. Violating undertaking given in Mutual Consent Agreement in First Motion and then backtracking amounts to Civil Contempt. This is so when after cooling period of 6 months upon your / your side's request to her to join for second motion she does not comply. Some record of callign her to join should also exists.

2. Remedy in above situation is to approach State’s HC under Contempt jurisdiction provided the payment that you claim in your facts were accepted and already used by her. HC will call her and after examining her reply and post parties arguments grant MCD.
