Divorce

Respected Sir,

 

I had got marry on feb 2012 .in between I dont have any concept for my wife past history of her befor marraige .after one month I had seen she have epilipsy desise and that has proved by eeg test and the past history was she had taken up valforate tab iwhen she was in  11 - 12 class reading.and after some of days go i think she have some mentally problem also .the prove is that after some day ago she had told me that her past lover was deth by blood cancer,for that reason she is became very much depressed from that massage for her lover gon.and at last she had taken a susite decesion for that on few days ago and she had done that but luckly god have save her by me to attend over their and admitted her hospital at right time.she has taken 10 nos sleeping tab which is prescribe by her nuro doctor.i had totally socked .i love her very much.now i had went to phychiatry and doctor had told me that it will take time to may be solve the problem more then year of year.we dont have baby and we dont want right now.now i want to divorce . is it possible sir? if yes which ground will be sutable for me for divorce?please tel me sir as early as possible.

Either you say in your brief you love her or say you want divorce. Your brief is confusing due to your bad English language.

 

Above observation material whether you like my reply or not, now, I could suggest you only below;

 

1. The wife was suffering from epilepsy before marriage; the husband is not entitled to get declaration of nullity as the said disqualification has been removed during the pendency of the proceedings in Ref.: Lakshmi Narayan Guin and Ors. Vs. Niranjan Modak [1985 AIR 111, 1985 SCR (2) 202]

 

2. Best would be to show maturity to issue in hand and just like both of you decided on "not to have baby" same way mutually agree to file MCD (Mutual Consent Divorce) ensuring her lifetime neuro care by offering good Alimony.

 

Para 2 may work only if you have a large heart otherwise she will relapse the moment you stir the (no more dirty) word Divorce into her ears.

 

Calmly read this reply and consult local Advocate and then act accordingly.
