Patanting drug molecule

 

Sir, I got a potent drug molecule and also published in the international journal. Now  I want to file it for Indian patent so pls tell me wht is the procedure.

You can file PCT or ordinary application . Each has its own time line and system.

The following types of applications for patent can be filed are as follows
 Ordinary Application
 Convention Application
 PCT International Application
 PCT National Phase Application
 Application for Patent of Addition
 Divisional Application

PCT full form is Patent Cooperation Treaty

If you have published it before one year you have lost the one year grace period. If you file a patent now your own publication will destroy the novelty, which is one of the essential requirement for grant of patent.

However if one year has not passed from the date of publication you should hurry up and file an application with the help of a professional.

It is published in recent issue of the journal but after aceptance the same is published online since 12 Aug 2010 so pls tell me weather now i can or not.

If all the novel features are disclosed in the online publication, it will serve as a prior art for your own application.
