Land title is in my name but the patta is not

I bought my land in 1995 and my name is in the sales deed document (pathram). However i did not register for a patta. Until now we let the previous owner’s relative use the empty plot for raising her cattle. Recently we got wind that they acquired patta for our plot. The plot is in a survey with multiple other plots and we can not verify accurately who is the patta owner of which plot. Neighboring plot owners suspect she might have gotten patta for my plot and is looking to sell a part of my plot along with a plot nearby. How shall i proceed? Now i got wind that

Since the purchase of land dates back to 1995 and someone (neighbour) is using it, they (neighbour) can claim adverse possession, it is better to get the land endorsed / mutation sanctioned in your name in revenue records.

How can I get the land endorsed/mutation sanctioned in my name?


I am currently away from my village and can not access my sales deed promptly so is there another option other than for applying for patta online?

You can apply for name transfer of patta to your name from your vendor's name. 

You will be guided with further formalities after that

Do you recommend I do it online through the tnreginet or eservices website or through Tahsildar?

You may first start the process by whichever mode you may choose,  if one fails you may opt for other. 

If the other one also fails then you can approach court with a suit for mandatory injunction to direct concerned Tehsildar to do the needful.

It is better to consult and engage a local prudent lawyer for proper appreciation of facts/ documents, professional advise and necessary proceeding.

You bought the land in 1995 and for 30 years you neither occupied it nor cared for it. Under the law of limitation if a propety is in adverse possession for more than 12 years the original owner loses the claim. How did the relative of the previous owner get the patta without the necessary documents? There must have been some fraud in the Registrar's office. They may have suppressed the sale deed to you or may have declared that you are missing for 30 years. Anyway you have an uphill task. Good luck.

The land had an extra bit which was not in the initial survey. I guess they added the extra bit of land into a new survey and got a patta for it. The problem is it was a group patta and except for our name all the other members who have property in that survey's names are present including the relative.

Now you apply for patta and try to add your name also to the group.
