Revision petition contents unknown, seeking time to reply in high court

The respondents in the lower court suit have obtained a show cause notice against me from the High Court. However, I have not yet received a physical copy of the notice or the grounds mentioned in their revision petition. Since the hearing date is only a few days away and I have no knowledge of the contents, I am unable to prepare an appropriate response. Can I file an adjournment petition in the High Court requesting additional time to respond?

On receipt of notice you are required to file a vakalatnama before high court and ask for the copies of the petition during first appearance.

Appear in high court on date fixed and ask copy of revision petition from respondents and request high court to grant time to you to file your reply.

Did you not receive the notice from the HC? How did you know that?  However, you know that there is a case, you please attend the court, pray for a copy of the petition to give a reply.

If you are aware of the case/ date /court and case details it is better to appear through  your lawyer, even if you did not get a notice.

Yes, you can file an application in the High Court seeking an adjournment or extension of time to file your reply. Since you have not yet received a copy of the revision petition or the grounds on which the other side has obtained the show cause notice, you are entitled to ask the court for sufficient time to prepare your response. Courts generally recognize that principles of natural justice require both parties to have a fair opportunity to be heard. When you file the adjournment petition, you should clearly mention that you have not been served with the copy of the petition and therefore cannot effectively reply or argue the matter. In such situations, High Courts usually grant a short adjournment and direct the opposite party to serve you with the petition copy before the next hearing.
