Common wall issue in herman city, atfl, ambala cantt

Respected Sir/Madam,

I am writing to seek your opinion on the uncompensated use of a common wall by my neighbor, Mrs. Y, Ambala Cantt. Despite continuous efforts and prior communication to the Office of Town and Country Planning, Ambala, and Herman Properties Pvt. Ltd., this matter remains unresolved and continues to cause mental and emotional harassment to my family, especially my senior citizen parents.
We came here to see the home. Mr. Z assists us in seeing homes. He is having business here. Then we purchased our property in May 2022 from a Dealer, which was ready to move in, thus we haven't constructed anything. But no one told us about the common wall concept!!
which we got to know when the next home was built.

We purchased our property in May 2022, and by August 2022, Mr. X approached my father, along with one of his known acquaintances, requesting permission to use the common wall. He assured that no damage would be done and committed to compensating for its use. Trusting his word, my father granted verbal permission.

However, once the construction was completed, Mr. X began living in the house without settling the promised dues. Initially, he claimed he would clear the dues in two to three months, then extended it again by another year with vague assurances. Eventually, excuses became permanent. Till date, no compensation or damages have been paid.

On 24th March 2025, I applied to the Common Welfare Association. but no action was taken. After continued neglect, a second letter was submitted on 11th June 2025, demanding action by 15th June 2025. Only after this second reminder was a meeting finally convened on 15th June 2025 at 11:55 AM.

We (myself, my mother, and my brother) attended the meeting along with the President, Secretary, and an Executive Member of the association. Mr. X, along with his wife (the house is in her name) and their acquaintance, attended from the other party. In the meeting, he refused to pay the full amount and instead offered only ₹33,000, outright denying responsibility for any damages.

On a later date, after discussion with the architect, the architect told me that he raised his offer to ₹40,000. However, this amount is not acceptable considering

  • No compensation has been offered for the damages caused.

  • No consideration has been given to the interest over the three years of delay.

  • He has taken occupation of the premises without settling his dues.

  • We have not been informed of any completion certificate or NOC—if issued, we demand to know how and why, without our dues being paid.

This situation has caused tremendous mental harassment and emotional distress, especially to my parents, who are senior citizens. My father, a retired superintendent from Customs and Central Excise, New Delhi, who served the nation with integrity, now feels cheated and betrayed.

I went to the Office of Town and Country Planning and asked them to look into this matter seriously, but they said that this is not under their jurisdiction. I have mailed several times but didn't receive any answer. WHAT TO DO? Why is there no hearing? The duty of the administration must ensure such cases are not encouraged or repeated and that genuine, law-abiding citizens are protected from exploitation and deceit.
 I AM FEELING VERY LOW, AS MY FATHER IS INVOLVED HERE. HE IS 69 YEARS OLD AND IS FEELING VERY DISHEARTENED. THEY (MOTHER & FATHER) BOTH ARE FEELING CHEATED.
IS THERE ANYONE WHO COULD TELL ME HOW TO RESOLVE THIS ISSUE?

Take help of local lawyer for proper legal guidance as your case is complicated one.

You can note the points that has caused you the grievances what you have narrated here and look for getting your grievances redressed through legal forum either thorugh the consumer commission or through civil court with the assistance of an experienced lawyer in the local.
