Dear Experts... I live in a housing society building where there are four flats with a Common Area. One of my neighbor has been placing his Shoes right next to my Shoe rack on my side and upon objecting is getting Aggressive. The neighbor is one of the Managing committee members. My Second neighbor has placed one end of the banner on a hook which is placed on my side of the door and he Also has same reaction saying this is a common space .I have raised this with Society but to No Avail. In this Scenario what are my Legal Options...

To address the issue with your neighbors, consider the following steps:

Documenting Incidents - Keep a record of each incident, including dates, times, and descripttions of the behavior.

This documentation will serve as valuable evidence when seeking legal recourse. -

Take photos or videos of the shoes placed next to your shoe rack and the banner on your side of the door. Communicating with Your Neighbors - Attempt to resolve the issue amicably by communicating with your neighbors in a calm and assertive manner. Express your concerns about their behavior and request that it cease immediately. -

If direct communication doesn't work, consider sending a polite yet firm letter or email to your neighbors.

Seeking Mediation - If direct communication fails, consider seeking mediation through your housing society or a neutral third-party mediator. - Mediation can help resolve disputes without escalating to legal action. Legal Options -

*Civil Remedies*: You can seek civil remedies through legal channels, such as filing lawsuits for injunctions or damages against your neighbors. -

*Restraining Order*: If the harassment persists or escalates, you may be able to obtain a restraining order against your neighbors. -

*Consulting a Lawyer*: Consult with a lawyer specializing in property or neighbor disputes to explore your legal options and determine the best course of action. Escalating the Issue

- If the issue persists, report the incidents to the relevant authorities, such as the police or local code enforcement agencies.

Provide them with the documented evidence to support your complaint. -

If your housing society is not responsive, consider escalating the issue to higher authorities or seeking assistance from a local housing authority.

 Key Considerations -

*Common Area*: Since the issue involves common areas, review your housing society's bylaws and rules to understand your rights and responsibilities. -

*Managing Committee Member*: Given that one of the neighbors is a managing committee member, it may be challenging to resolve the issue through internal channels. Consider seeking external help from a lawyer or local authorities. -

*Evidence Collection*: Collecting evidence and documenting incidents is crucial in building a strong case if you decide to pursue legal action.

it's illegal but some family want more area that's why they think common area made for them and they want to capture whole area.

It is a disturbing factor hence you gather the evidence and issue a legal notice to those people to remove the obstructions in the common area, failing which you can take it up legally either through the registrar of cooperative society or local civic boidy or by filing a suit for permnent injunction against them in the cooperative court.
