Does a person require to take court decree to prove her husband is dead inspite of the fact that her husband is not heard of since last 8years.

If some thing has to be established as a fact/truth to make claims, it should always be through Court alone.  Their orders are final and binding.

First and foremost indicate whether any police complaint was lodged about missing of the person in question?
