I am a practicing advocate and have filed an application for condonation of delay. The delay of 532 days has been caused to file a Miscellaneous application to restore an exparte award. The aggreived party approached me recently and informed about the misguidance by the the counsel to whom he relied. Further I took an instant step by filing a miscellaneous application under rule 26(2) of the Industrial Disputes(Maharashtra) Rules 1957 to set aside the exparte award supporting it with the seperate application for condonation of delay. I need to support my case with a few judgememts. I have gone through many case laws but are not helpful. Can anyone help me out with the relevant judgements. Regards
