ARBITRATION

What is the procedure to enroll as an Arbitrator in tamilnadu.  If any body having procedure kindly post and guide

Dear Ganesan S.

A contract is entered between two or more parties.  In the instrument generally there will be an arbitration clause to arbitrate the matter  in the event of parties to the agreement or contract.  Generally depending on the number of parties each party can nominate an Artbitrator who are capable of arbitrating the dispute.  for e.g. two parties to the contract can appoint 3 arbitrators one amongst them will be a principa Arbitrator whose decision will be binding on the parties as well as on other two arbitrators. However, the Arbitrators should possess adequate knowledge with the subject matter and the relevant law.

Yes, I agree with Mr.Ganesan.

There is no any special qualification needed for a person to be appointed as an Arbitrator.

He shall have good administrative capacity (?), to conduct the Arbitration, to find a solution and to dispose the dispute.

For that he may need, some basic knowledge (Practical), exposure to the matter of arbitration to understand teh dispute.

That's all.

The Arbitrationa nd conciliation Act 1996 does not prescribe any qualification for the Arbitrator.Any body having knowledge and conversant withthe the procedures can Arbitrate. No registration of any  sort is required. The Nalsar University of Law is conductiong 9 months course by proximate Education  in  collaboration with the Internatuional Centre for alternative Dispute Resolution, New Delhi, and ithas posted the nakes of the Arbitrators tra.ined by it in its website.

There is qualification to appoint a arbitrator and there is no procedure required for it. It will deppend upon the parties who appointing you
