My father is missing since 2005. My grandfather lodged a diary report in 2006 and then my mother lodged FIR in 2007. According to the 7 years of period, my mother went to obtain non traceable report but police said that they sent those records to their records room so it hard to find your records so its been 12 years, they're not providing non traceable report. Kindly do let us know if there is any other way to obtain death certificate without non traceable report?
Under section 108 of Evidence Act, your father can be presumed dead, but for that you need to file a case in the court to declare him dead. If you have the copy of FIR, enclose it's foto copy with the application in the court.
Please read that ruling to gain knowledge of the subject and submit the application before any competent court with only the copy of the FIR which may be having the stamp of police station. Forget about the police report because everyone knows that police is not for the ordinary citizens.
