Most Respected Kiran Ji,Namaskar,I am so impressed with your response on my queries,plz enlighten me on the following issue. I have filed a criminal complaint u/ss 395/452/323 IPC & 25/54/59 Arms Act,now case is fixed for consideration on summoning,i want to know as there is no recovery of arms & looted articles bcoz complaint was not sent to police for registration of FIR by the magistrate and magistrate ordered for recording of preliminary evidence than question of recovery is not arise,now i want to know whether court can summon the accused under section 395 and Arms act without recovery of arms & looted articles..its urgent bcoz case is fixed for 20-7-09 for arguments on summoning point.Thanx

I am really thankful to you for your very important and fruitful advise. My client is at Bhavnagar, Gujarat state, where no proper lawyer is available to advice in this case. Hence in this case, I am asking for further queries as under : 1. The Insurance company have sent summons of California court on all partners of the company to local Bhavnagar court through Home Ministry . Please advise whether summons is to be accepted or not. We have yet not accepted the summons. The bailiff of the court informed that if you do not accept the summons, we will affix it on your door. 2. The material exported were certified by independent agencies as under : (a) Phytosanitary Certificate issued by Directorate of Plant Protection, Quarantine & Storage, Department of Agriculture & Co-operation, Ministry of Agriculture, Government of India.wherein they certified that products described have been inspected accordance to appropriate procedures and are considered to be free from quarantine pests and practically free from other injurious pests and they are considered to conform with the current phytosanitary regulations of the importing country. (b) Fumigation certificate issued by Pest Morten (India) Private Ltd., Entomologists & Exterminators. 3. There is no sale/purchase contract between exporter and importer. The material supplied only against their Purchase orders. 4. The importer is a trader and importing materials from various suppliers. How he can prove that the other articles found from our material only. 5. In the summons, it is mentioned that we have reply directly or through our lawyer within 30 days. Please advice whether we have reply anything or not. 6. Whether we can writ in High court mentioning there in that California Court have no jurisdiction for this case. hello sir, I have an unfortunate situation before me please help me............my grandfather has five sons my father being the eldest. all are engaged in different businesses we have a joint family no formal or informal partition has been done....every male member (my grandfather, father, uncles) have formed HUF and file IT returns for HUF & individual. the family properties are owned jointly as well as individually by different members including me. one of my uncles(A) who does business from a shop owned by my grandfather (he does not have any other income from job etc) he(A) has another shop on his name individually he says this shop is on his individual name n this will not be included in family partition everyone else is against this he(A) will not listen to any elders ,relatives regarding partition he(A) intimidates my grandfather so a will by my grandfather is very rare possibility....... the properties have been purchased from time to time by joint family money based on availability of capital on a members books of account.......other members have properties individually too but agree that all properties are joint family properties regardless of owners name (all properties were purchased by mutual consent) ........... what should me or my father do? please advice…… what’s the maximum ad valorem court fee for partition suit? I have heard it will take 10-15 years n our businesses will be ruined…….please suggest how should we go about it….. i have asked this in the query section n forum as well please help

Greetings of the day, I'm sorry, but that dose not work, I get to the part where I can see everything all my activities, but when i click on it it only says reply... please assist. My users name is neilhaslam90@rediffmail.com My password is woodpony45 I want to delete everything as its available on the net for one and all to view, Plus sad to say I am on my way and i have given up trying to save my broken marriage. Since the complaint lodged,there has been neither proceeding nor summoning.In short you may say red-tapism of the system.In the part of police Vs company who was at fault? Regarding other crimial proceeding,there has been no any such, except FIR of the burglary on D day.
