in a co operative housing .the person(member) whose name is in second in share certification will be eligible to contest election of the managing committee with the permission from the first name and the third and fourth.he has not fill any associated member form before. please guide associated member form should be filled by the second person in the share certificate to contest election. the election is in next month . my query is being the second name in the share certificate can a person contest election and what he has to submit to the returning officer . thank you please advice and give the by laws

Dear Sir, Very kind of you indeed Sir to have replied to my query . As per ur instructions i requested the Hon'ble Judge yesterday, though it was not my hearing date, to give me a copy of the documents produced by the bank (in lieu of Witness Summons to it) and told him that i will not be able to argue my interim maintenance in my next hearing without the copy of the same in my hand. The judge ( initially) promptly said that i could have it by applying for a certified copy of the same but was interrupted by the Sherishtedar (Assistant to the Judge) who is taking personal interest in my case and is prejudiced against me and has been playing mischief in my case by not recording proper Roznamma etc and pressurising me to apply for a mutual consent settlement. I pointed out to theHon’ble judge showing him the certified copy of the roznama that it was not yet taken on record and wasn’t marked as exhibit. Thereafter the Judge only told me to seek inspection of the document and make my submissions after two hours on the basis of the inspection made on the day of the next hearing . Sir, i say that the other party being influential i am worried that in the next hearing the judge may directly give orders for interim maintenance without taking the said documents on record before the same so that my appeal may be meaningless in the high court. I am praying to you to show me some Lawful way under some Rule or Order etc to enable me to make an application on that grounds and by taking the matter on board etc... so that i can lawfully compel the judge for taking the said documents on record...... I doubt if i pray for summonning the bank manager as witness , he may set it aside saying that it can be done at the trial stage after interim maintenance is granted. Sir , i want to file an application for Perjury based on the said bank documents ( which reflect the salary,earnings and investments of the Petitioner who has denied her employment on affidavit .It doesn't give me any sadistic pleasure to file a perjury application but the other party is so unreasonable , fraudulent and malicious that it has become the need of the hour. They have on earlier occassion even submitted different copy to me and to the court of the same application fraudently. May i again request you to please guide me further ....i am arguing my case in person and also studying Law as student in my first Sem and my exams are just two days after my next hearing and i am unable to concentrate on my studies . i have also lost my job. will always be greatful for your time on my matter....Regards.

श्रीमान महोदय, मुझे कानूनी सलाह चाहिए जिसमे मुझे एक वरिष्ट पुलिस उपनिरछ्क द्वारा फसाया गया है , और मुझे मारा व पिटा गया है । कल रात 9 बजे की घटना है , मेरे घर के नजदीक में पुलिस स्टेशन है और वहा पर कल रात्रि रामलीला हो रहा था । मैं अपने दोस्त के साथ घर आ रहा था । जैसा की मेरे घर के रश्ते में पुलिस स्टेशन आता है और उसी समय वहा पर रामलीला भी हो रहा था और बहूत भीड़ भी थी । उसी समय मेरे दोस्त ने जोर से चिललाकर कह दिया की " जागते रहो " इतने में वहा पर ड्यूटी के समय उपस्थित वरिष्ट पुलिस उप निरिछक ने सुन लिया तब तक उन्होंने कुछ भी नहीं किया हम लोग वहा से कुछ दूर चले गए थे कुछ समय बाद पुलिस साहेब ने कुछ कांस्टेबल को भेजकर मुझे और मेरे दोस्त को बुलाया गया और पुलिस स्टेशन में अन्दर ले जाकर मारने लगे और कह रहे थे की पुलिस वालो का मजाक उड़ाते हो और कहते हो " जागते रहो " इतना कहने पर की हम लोगो ने आपको देखकर नहीं कहा था इतने पर उनको और गुस्सा आ गया और फिर तो उन्होंने मुझे डंडे और लात (पैर ) से मरने लगे । कुछ समय के बाद पुलिस ने मुझे और मेरे दोस्त को पुलिस हेड ऑफिस में ले गयी , ले जाते समय पुलिस गाड़ी में 3 स्टार पुलिस अधिकारी ने भैया और यू पी वाला कहकर गाली देने लगे और कह रहे थे की तुम्हारे नाम पर ऐसा सिकायत ( एफ . आइ . आर ) दर्ज करेंगे की कही तुम भैया लोगो को नौकरी भी नहीं मिलेगी और तुम लोग तो चरित्र सर्टिफिकेट के लिए यहाँ आओगे न तो देख लेंगे कैसे मिलता है यह सब कहकर और माँ -बहन की अश्लील गालिया देकर महिला पुलिस के सामने मजाक उडा रहे थे और हमें डरा रहे थे । इसके बाद जब हमें पुलिस स्टेशन ले गए तो रात के 1:30 बजे तक हमारे खिलाफ कोई सिकायत नहीं लिखी और हमें लॉकअप में बंद करके रखा था । जब हमारे परिवार वाले वहा पर पहुचे तो उनके साथ बड़े कठोरपन के साथ बर्ताव कर रहे थे और कह रहे थे की साले लोगो को कही नौकरी भी नहीं मिलेगी । अंतत: रात को 2:00 बजे मुझे और मेरे दोस्त को 1250-1250 रुपये के दंड वस्लुकर छोड़ दिए और उसकी रसीद भी दी है । परन्तु मेरा कहना यह है की हमने उस वरिष्ट अधिकारी को देखकर ऐसा कुछ नहीं कहा हमने माफी भी मांगी पर अधिकारी सुनाने को तैयार नहीं थे । उन्होंने हमारे खिलाफ धारा 112/117 के अंतर्गत सिकायत दर्ज करके छोड़ दिया है और कोर्ट में जाने के लिए कहा है । 1) मैं आप लोगो से ये जाना चाहता हु की मैं ऐसे वरिष्ट अधिकारी के खिलाफ अपनी सिकायत कहा और कैसे दर्ज करू ? और उसका प्रारूप क्या होगा ? जैसा की वरिष्ट अधिकारी को " जागते रहो " बात से चिढ आ गयी थी का मतलब है की वो अपने ड्यूटी पर सो रहे थे और हमने उनके सोने पर मजाक उड़ाया है अतः मुझे ये बताइए की क्या " जागते रहो " एक गाली है ? या पुलिस वालो के लिए अपमान जनक (सूचक ) शब्द है और यदी ऐसा नहीं है तो कल भविष्य में इन्कलाब जिंदाबाद, वन्देमातरम और भारत माता की जय जैसे स्लोगन कहने पर पुलिस स्टेशन जाना पड़ेगा । 2)मुझे कोर्ट में हाजिर होना है अतः : मुझे ये बताइए की क्या मैं इस शब्द को लेकर अपना गुनाह कबुल करू या मैं उस अधिकारी के खिलाफ सिकायत दर्ज करु ? 3) उस अधिकारी ने मुझे पुलिस स्टेशन में लात से मारा है और मुझे अपमानित किया है क्या मैं इसके साथ अपनी मानहानि का दावा बिना किसी वकील के कर सकता हु ? 4) क्या मुझे अपने बचाव के लिए सरकारी वकील मिल सकते है ?? 4) क्या लात से मारना हमारे मनवा अधिकार आयोग में छुट है यदि नहीं तो क्या इसकी सिकायत मानवा अधिकार आयोग में की जा सकती है ??? 5) क्या वरिष्ट अधिकारी माँ - बहन की कठोर गाली देकर अपमानित करे तो उसे सहन कर लेना चाहिये ?? 6)पुलिस द्वारा झूठे मामले में फसाने की धमकी देने के बारे में कैसे और कहा सिकायत दर्ज करानी चाहिये ??? 7) क्या मैं बचाव के लिए पुलिस स्टेशन में लगे cctv कैमरे की फुटेज ले सकता हु जन सुचना के अधिकार के अंतर्गत ले सकता हु । यदि ऐसा है तो कृपया जानकारी उपलब्द कराये । धन्यवाद !!!
