Respected Sir, Thank you fro your time, i have left this inquiry in the general form but couldnt get any answer, please sir i am in a very troubled state of mind kindly help me with this query.Dear Sir abouta month back my commercial vehicle hit a pedestrian from Bihar as he was crossing the road. Later took him to the hospital and treated him for few days. The injured ( Fracture in one bone). Police registered the case and my driver was arrested and later released on bail. I have already released my vehicle. chargesheet has been filled in the court. Now i am receiving threatening calls from some person claiming to be the lawyer of the injured. He has even sent a without prejudice notice in my favor asking for 6 lacks as compensation. i was not worried as i was told that the insurance company will take care of the claim if any arises. but today i found out that my driver has two licences one a fake commercial licence. and one genuine L.M.V. licence almost 3 years old. I dont know what should i do now. shall i bow or is there anyway any law which can spare me from paying any compensation if arises. Further i need to know can the injured / advocate file a case in his home state for the compensation and if he does will that mean that i have to go to his home state to defend the case. Thank You,

  • Arun K Sreedhar says : Release order
I am a geologist working in Geological Survey of India, Ranchi. By an order(issued in July 2013) I have been transfered to Kochi with effect from 1-10-2013. But my transfer has deferred in October 2013, pertaining to submission of an official report. The report was submitted in November 2013. But again my transfer has deferred till further order. Is this order is valid? Can I join my new office at Kochi with the letter issued by head of office?. Please reply me I also received different amount of salay in each month for the last four years. What I should do recover my lost money with interest?

  • Dr. Prakash Kulkarni says : Discrimination of Women Medical Examiners of LIC
Dear Mr. Sudhir Kumar, We are a charitable organization active in women’s empowerment and women’s issues. I am bringing to your notice following facts. Here I or my Trust is not a victim, nor do we represent any victim or group of victims. We are doing this for public interest. LIC of India has appointed Medical Examiners all across India, to examine the Life to be Assured. They do not provide the Administration Manual to them. LIC Agent or Development Officer brings the cases to them. The medical Examiner examines the case and afterwards LIC pays the fees for the medical examination. We noticed that a male medical examiner of LIC of India was allowed to examine female Life to be Assured with her consent. However, Women Medical Examiners were not allowed to examine male Life to be Assured at all. We understand, this was being practiced since long, probably, since the inception of LIC of India. I asked questions regarding this to LIC of India under RTI. The answers are as follows:- 1) The above information is correct. 2) This is mentioned in the Administrative Manual of LIC of India which says:- E. Acceptance of Medical Reports:- e:- Females:- Female lives should be examined by appointed Lady Doctors only and, in their absence, by Government Lady Doctors, if available. Where the examination has to be conducted by a male examiner or a male gynecologist, such examination should be carried out only provided the female proposer has no objection to having the full examination including Per Vaginal Examination, made by such examiner without the aid of a nurse or midwife. PV Examination need not be insisted upon in case of single ladies aged below 30 years. f:- A Lady Doctor should be asked under any circumstance to examine a male life. Such reports will not be accepted and no fees paid thereof. 3) This procedure is being followed since a long time. This looks to us as a Discrimination against Women. Nowhere else in this world a doctor is prohibited by law / rule to examine patient of opposite sex (with the patient’s consent). It is surprising that nobody in whole LIC has noticed this fact in last so many years, or they might have neglected it. Thus I had submitted the complaint to Corporate Grievance Redressal Officers of LIC of India on Oct. 4, 2013. Nothing happened for 3 months. Finally I had to complain to The Internal Complaint Committee of LIC of India, and the rule was changed on 18th Feb. 2014 vide LIC letter no U&R/103/2014. Now there is no discrimination. This was half part of my complaint. For long time the women examiners were suffered. Discrimination against women is a serious matter and is a violation of Article 15 of Constitution of India. Thus they need to be compensated. Usually the compensation issues for the crime against women has been resolved by the various courts and the supreme court guidelines are as follows:- 1) Written apology 2) Compensation towards loss of business / wages 3) Compensation towards discrimination 4) Interest on the above amounts. Traditionally, and even today, a woman is taken as granted, without even considering her status in the society. Crime against women is increasing day by day. Unless we have ZERO TOLERANCE POLICY for any crime against women, the situation in India will not improve. Thus the above action is very much necessary. I had also complained to the Helpline of President of India. This request was rejected by the LIC of India. These women medical examiners may not even be aware that they were being discriminated. Is there anything we can do ? Thank you. Dr. Prakash Kulkarni
