My friend got a property by settlement from his father in 2010.His father has availed loan from a Bank and was in default.In 2013,the DRT issued an order to attach the property.That property was not mortgaged or my friend was a gurantor.The attachment order specifically has named my friend's father name.In 2013, my friend's father was not the owner of the property.
The Sub Registrar must returned the Order informing the DRT that the said property is no more in the name of the person mentioned in the Order.
How to deal with this? I prefer a complaint against the Sub Registrar and ask him to cancel the attachment.
Pl advise me further.
