1. In RCR there is no where written that if RCR is filled then it can't be withdrawn.

 

2. If the person goes for MCD then he must wait for 6-7 months of time.

 

3. If a person goes for MCD then he has show a clause in MOU about the settlement issue on financial matter.

 

4. After decree of divorce through 13B HMA i.e MCD the both couple who is going to be seperated will be called as divorcee for whole life after divorce.

 

 

Now come to voidable marriage i.e U/s 12IA & 12IC

 

1. If you want to close this issue then one has to allege that other partner as impotent and this impotency varies in different-different situations which had led to non-consumption.

 

2. Now, other option as the marriage occured due to supression of any matterial facts related to marriage.

 

 

In procedure:

 

1. When both couple is eager to dissolve marriage without any force,fear or coercion and they want to get the tag of unmarried then better choose the ground of voidable marriage as per the reason stated above.

 

2. If a wife goes to file for voidable marriage claimaing any matterial facts which has been mutualy decided by both couple prior to filling, then after filing of such case ,husband will get notice for WS.

 

3. In this WS if husband also accord the same and write that yes these were not discloesd prior to marriage and easily accept the allegations then most probably within 2-3 hearings the decree of nullity will be granted to wife against husband and within short span both will be freed.

 

4. In other Instance,if husband gets notice and then also not turned for 3 hearings and wifes lawyer convince the court for making him exparte then also you will be freed easily within short span after getting the tag not as divorcee.

 

Now its your wish to choose MCD or voidable marriage both are options opened to you.
