Vat rate on combo offer

hi

In a multiplex in a combo offer (Pepsi+samosa) is being sold under name of Samosa combo.

The Bill reflects the same as Combo(not shown separately as Samosa and Pepsi).

If sold separately, then samosa vat rate is 12.5% and Pepsi is 20%.

My question is that, at what rate they should charge vat on combo offer.

whether at proportionate rate or at maximum vat rate i.e 20%,

When combo offer is given in that case the goods sold samosa and pepsi is free. The rate of tax will be applicable for samosa only but the problem is whether the dealer can by pepsi against C from or he can get the input tax in the case of purchase from the state after payment of VAT. Therefor, it is advisable to segregate the amount of pepsi and samoso and charge the vat accordingly. If you charge higher rate of tax then the tax department will not have any problem but the customer is looted.
