Terrace flat

Hello,

My apartment has got an open terrace which is covered by shade. Recently, there was an incident of a flower pot felling from the floor above on the shade and damaging the shade and the tiles.

I came to know that such incidents cannot be termed as accident as it is the responsibility of such flat owners to either get their balconies grilled or to keep the flower pots on the ground.

It would be very helpful if someone can guide under law there is such a provision.

It purely depends on facts and circumsatnces. and from many years the pot was there on the place. But, you may ask them for compensation for the damages you have incurred because of that, and not more than that.......
