Shop eviction from tenant in kanpur

Team, My Father in law has rented a shop in Kanpur in 1997 but the tenant is not vacating the same now. There was a rent agreement made for a period of 3 years with extension clause for 3 years with a rental increase by 15%. Tenant has another shop in the same market which he has rented to a bank. Now we want to get the shop evicted by the tenant. Can you please advise : 1. How much time it would usually take to get the property evicted by the tenant and what is the process of the same? 2. What would be the cost of the same? 3. Would it be quicker to get rent revised to market rates, than getting the property evicted? And what is the process of the same? 4. Does district administration (SDM etc.) have any right to act in this matter? If yes, then what they can legally do, for a quicker solution? Thanks Sharad

Members in the forum can not answer or guarantee any time frame for such eviction..   Contact a local advocate and discuss with him.

An eviction notice must first be served properly and the tenant must have failed to comply, pay, or vacate within the specified timeframe. This must happen before the landlord can begin the eviction court process by serving you an “unlawful detainer”eviction lawsuit, called a Summons & Complaint.
