Rti-documents as evidences

Respected Experts,

Whether the documents in duly certified photo copy format in accordance of   Sec.2 (j) (ii)  of RTI Act-2005 obtained are accepted as evidence  in a criminal case in Trial Court. Kindly clarify.

Even before RTI Act enactment, Indian Evidence Act has stated that one can seek such certified copy and that it serves for evidence part.  But, some judges strangely reject the evidence stating that that officials of Public Authority were not examined and though document is admitted, they can not take it granted.

Dear M/s. G.L.N.Prasad/ SHIVAM/ BHRIGU DATTA,

Thank you all for your response to my query. The Certified Photo Copy of the Documents which were obtained through RTI is of Revenue Dept. of the local body here & the PIO is the Revenue Officer of that local body. He has Certified & Signed those Docs as PIO & Revenue Officer of the Local Body.
