Resale flat - refund token money

I have booked a flat in my Society and given 6 lacs payment to owner by cheque. We both party has signed MOU (not notarized). However due to some financial problems and owner rude attitude I have cancelled the deal. In MOU point had mentioned that if deal get cancelled then owner will refund full money. Now he backstep and saying once the flat get sold then he will refund. It's been a month but no much moments and he increased the selling amount. Already there are many flats not getting sell in less amount. He had given our payment to other person. Please help as it's hard earned money and there is tension environment in family.
Please help us to come out.

Be confident that your money will be refunded.   Issue a Registered Legal notice to keep the transaction within limitation period.  If your needs are urgent, find out a buyer and contact an advocate to get the appreciation value through a smart undertaking without purchase.  (If there is a clause that builder has to register it either in the name of purchaser or his nominee, this may be used to your advantage)
