Reply to summon

Respected Forum members,

I got divorced 2 years back through mutual consent. The custody of child was given to me in divorce decree. My ex took away 7 year old child forcibly in my absence. Thereafter he filed a custody case at his place which we were not aware of. We filed a case for kidnapping  in our place and got the child back. Now the child is with me and we received a summon from his place for the child custody case. I have already signed an affidavit in supreme court stating that I reside in place A , the petition for transfer of the case has yet to be filed in court. Meanwhile such situations arose that now I have to shift to some other place B approximately 4 hrs run from place A. What is better that I get the case transferred to place A by hiding the fact that I am residing in place B. OR should i sign fresh affidavit from place B?

Yes. You have to submit fresh affidavit of place B as per your version.
