Reconstitution of land

Our builder had put up multi story residential apartment that had used FSI from a neighboring piece of land -- also owned by the same owner. The neighboring piece of land and our apartment has a common right of passage. The apartment was built 20 years ago. Now the builder is asking for a POA from all the current owners to do a reconsitution of land so that the builder could get the prevailing FSI to build an apartment showing the empty neighboring piece of land and the land where our apartments are built.

We are not interested in the request for POA. If the owners are not interested, what other venues are available for the builder? 

Let know if any clarifications would help for a response from the expertise of the forum.

builder has to pay compensation according to market value. or else owners can give complaint to the municipal authorities for trespass by the builder file a criminal/civil complaints.

Are there any other ways available for builder to bypass the owners and put up a building?
