Quash in hc

Dear Elite Members

                               Plz enlight me if a quash has taken place in 498A in HC can the opposite side has a chance to challange in SC

Yes it can be challenged in the SC, if you have sucessfully got a quashing done, then consider putting a caveat in the SC to pre-empt any adverse ex parte orders.

The aggrieved party can file an SLP in the SC. However, I don't consider any necessity of filing a caveat in a case of this nature as unless and until the SC reverses the decision of the HC to quash the proceedings, the same will not be restored to the file of the trial judge.
