Property dispute

Hello team,

I have heard alot of this blog but was not able to understand how to share my problem actually i'm right now in a struggled situation, hoping you as a friend can help me to resolve my doubts and worryness.

Well, i have one property which belongs to the name of my mom. Talk about the background of my family, my papa has three more brothers and one sisters, all are married. My papa is the eldest brother in the family.

Talk about one of his brother, he separated a way back in 1998 from this house. Later on in 2000, the last youngest brother of my papa separated. Now only two bros left (one my father and another one),so during 2004 some dispute happened and they all decided to sale the property and divide the money between two. But what we did, we purchased that property and give the half share to the other uncle.

Now to clear you the concept of the initial owner of this property: The owner was, the brother of my grandfather i.e. mere dadaji (who is not alive) ke brother. He was the original owner, so during 2004 disputes, he transfered the rights and title on my mom name.

Now after many years, my dadi is demanding the rupees as a part of share which she didnt took at that time. Again the reason she is asking because the property value has gone up and the wealth position of my uncles has gone down, so they are actually lotting us.

Now i'm not getting the support from legal system because they are saying that dadi ka toh share banta hai but we paid everything to them and also this property is transfered by the brother of my dadaji.

What are the actions that i can take on this?

How can i safeguard this?

Do police help me to protect from this? because they have hired some localites gunda who took the possession from our end?

I'm looking forward to this help. Thanks everyone.

If they took illegal possession, you must give  a complaint to police for trespass, encroachment and land grabbing after which file a suit for eviction.  Since the property was transferred on your mother's name, it becomes her own property, nobody can claim any right of share in it.

Thanks T. Kalaiselvan for your reply, but i am actually in a fearful condition because they have taken our possession of our property with all gas and cylinders kept...with the intention to show that my grand mother (Dadi) is living there since many years. Yeh unhono just dikhava kiya. Now the PI of our area is also not agreeing that this property is ours and taking as a complaint, he is saying that jab tak maa hai tab tak uska hakk banta hai on this property, so not sure is this a setting between that gunda and police force. I'm actually in a helpless situation and need a help on this because this is the only property that we have saved after working so much hard.

So how to safeguard as police is also not favoring us.
