Procedure to get declaration of void ab initio marriage ??

 

what is the procedure for filing declaration of annullment of marriage u/s 11 and 5(i) of HMA ??

Documents i have :

a) registered divorce deed of the wife. (regarding her first welock)

b) divorce decree issued by family court of myself. (regarding my first wedlock)

c) marriage certificate issued by priest (Hindu vedic method - Place : Alandi, Pune)

 

Questions : 

1) will any other documents be required ??

2) what will be the procedure in this case ??

3) will the court proceedings be contested / non-contested ?? 

4) is the wife also required to be present in the court during the proceedings ??

5) in such a case, is it required / a must to appoint a lawyer from my side ??

6) is there any standard format of petition to be presented to the court ??  


7) age declaration by my wife at the time of her marriage with me = 31 years (as indicated on our marriage certificate)

her actual age at that time = 34 years (as per her Pan card - i have a copy of her Pan card)

should i go for only section 11 / both 11 & 12 ??

i have also sent a letter to wife on plain paper - stating that - our marriage is void ab initio and  from my end, she is not entitled to receive any benefits out of our marriage ... etc ... etc.

i have sent this letter by Registered AD
