We have a property in a town of Karnataka under town municipal council (TMC) jurisdiction in my father’s name through registered partition deed after my grand father’s death. We are paying tax as per municipal assessment, the katha stands in my father’s name before it stands in my grandfather’s name) and we are in the possession from more than 45 years. For the same property my grandfather has got the permanent injection order against town municipal council in a title dispute case around 35 years back. The court have been ordered and decreed that “the town municipal council (defendant) should not disturb the peaceful possession and enjoyment of the property and ordered to pay the court fees of the both the parties by the town municipal council. (In this case we have not asked for the declaration, we got only permanent injunction order).
But now for the same issue they (TMC) are disturbing the property by giving several notice to give the details how this property came my grandfather (who died in 2002) and they tried to demolish the property in one time during mid of 2015 and we prevented them by demolishing the said property by showing the permanent injunction order against TMC. We have given many reply and documents to the town municipal council as a reply to their notices but the chief officer is asking the same question in each notice.
My questions are:
1)If my grandfather doesn't have a proper title before the permanent injunction order (1979), is this will leads to any problem to the property in future?
2)Will the court give the permanent injunction order for the property of the improper title?
2) The documents what we are having now is not enough to prove our title (Partition deed in 2007, katha extract, property assessment, Tax paid receipt of 46 years, building plan approval, Permanent injection order etc.,)
3) Can we file contempt on that officer regarding this issue?
4) What are the documents required for the contempt case.
5) Is there any adverse affect on property by filling the contempt case?
Kindly advice regarding this issue.
