A flat in cessed building of MHADA has beed transferred by the Society in the name of a widow which was earlier in the name of her deceased husband. This widow is presently staying in the same flat, does not have any children and intends to sell this flat for her livelihood. The society claims that NOC for the sale of this flat cannot be given since the transfer of title has been done in her name only three months ago and hence the flat cannot be sold for a period of one year from the date of transfer.
Is this ruling as per Law or any Bye Laws of Co-op Society.
