If we go for mutual consent divorce...

1. What are the important points to mentioned in the mutual consent divorce petition.

opinion: What ever concerns you have and doubts related to your settlement put all in your MOU so that it can't be claimed further by her.

2. How can we safe our self from future misuse.

Opinion: Once MOU been prepared and signed infront of the judge and divorce decree been passed to both of you,No further claims or misuse.

3. any other points do you want points out/guide.

Opinion: Same as above,don't miss any doubts.

4. How to proceed further.

opinion: Talk with her on this issue. Hire a common lawey for MCD,Preapre the above MOU and put infront of the judge for first motion,judge will see and ask both of you to come after 6 months. This 6 month is called as cooling period.In this period either of the party can change his/her mind and no body could force on that. Once 6 months completed ,the judge verifies once again the consent and passes the decree of divorce.The decree copy been given to both parties within few days.
