Nanavati Commission will decide next week on summoning Modi


The Nanavati-Mehta Commission, investigating the 2002 post-Godhra riots in Gujarat, will pass an order some time next week on an application moved by NGO Jan Sangharsh Manch (JSM), demanding summoning of Chief Minister Narendra Modi and others to examine their role in the riots.

 The Nanavati-Mehta Commission, investigating the 2002 post-Godhra riots in Gujarat, will pass an order some time next week on an application moved by NGO Jan Sangharsh Manch (JSM), demanding summoning of Chief Minister Narendra Modi and others to examine their role in the riots.



Justice G T Nanavati, as Chairman of the Commission, after hearing Advocate Dr Mukul Sinha representing JSM, and State Advocate General Kamal Trivedi, decided to pass the order in this regard some time next week, but refused to give any specific date.



Advocate General, in his oral submission on July 11, had vehementally opposed the application of JSM and prayed to the Commission to reject the NGO’s demand. On July 10, Adv T S Nanavati, representing the state, had submitted a written submission opposing all the allegations made in the application.



In reply to the Advocate General’s submission, Adv Mukul Sinha in his rejoinder said summoning certain persons named in the application are under section 4 of the Commission of Inquiries Act, 1952. He also said at the stage of summoning any person, no allegation is required to be levelled or proved, but to know whether the person has any information or knowledge of the facts connected with the subject matter.



Dr Sinha said the applicant has merely pointed out the conduct of the Chief Minister, the then Minister for State for Home Gordhan Zadaphia and others, as it appears from the record before the Commission. He contended that persons named in the application under section 4 of the Commission of Inquiries Act is absolutely necessary in order to form an opinion by the Commission regarding the role and conduct of the persons.
