A legal heir certificate is required to  claim the assets and other rights (such as insurance, pension, arrears, and other receipts) of the deceased person. The certificate is used to establish relationship between the deceased and their legal heirs. After obtaining the death certificate of the deceased, successors can apply for this legal heir certificate.
‌First of all the heir is required to approach the concerned authority of municipal corp or taluk office. Or tehsil or district court and obtain the legal heir certificate application form and then duly fill it.
‌Before submission of the application, the requisite documents are required to be attested and then submitted along with the duly filled application form. Required documents include identity/Address proof of (Aadhar, pan card, Driving license, etc) the applicant and deceased; Death certificate of the deceased; Date of Birth proof of all legal heirs; A self-undertaking affidavit on stamp paper
‌After submission of the application, the revenue/ administrative officer conducts enquiry to verify the credentials and after the completion of successful verification, the certificate is issued.
Under law, usually the parents, children or spouse can apply for the said certificate. Although the court has granted recognition to other relationships after proving considerable dependence of the supposed heir upon the deceased.
