A Government order, G.O(Ms) No.1837, Public(Law & Order C) Department , by the Tamil Nadu Government wherein the Government has directed that one of the legal heirs of the victims who lost their lives i the violent incidents that ocured at Coimbatore from 29.11.97 to 3.12.97 and in the bomb blasts that occured at Coimbatore on 14.2.98 be given preference in providing employment at the entry level posts in Government Offices\Government undertakings considering this as a special case and on sympathetic grounds.
One Mr.xxx died in the above said blast. He is a muslim man who was unmarried. In the legal heir certificate issued by the revenue authorities, only the name of his father and mother is there. However the deceased man's brother is requesting for a job, saying that his mother and father are old. His father has also issued a no objection certificate issued for employing his son.At this point i would like some clarifications.
1) Who are legal heirs of a deceased unmarried man?(Assuming his father, mother,brother are alive).
2) I presume Legal heir is based on Hindu Law. Is there separate definition for Legal Heir as per Muslim Law?
3) Can the brother of the deceased man, be considered as a legal heir, in the absence of his name in the legal heir certificate issued by the Revenue authories.
