if defense is absent

nothing happens. courts gives then a thousand chances. to escape such events.. :)

 i am too much disappointed with the judiciary system as there is no watch on them.. 

  And nothing can be done to a judge who has given wrong decisions..

Agreed, the wonder of our Judiciary is that the judges is at liberty to decide rightly or wrongly and there is nothing we can do to their intentional wrongful discreation, except to appeal; that is waste of  tax payers time and money.
