Dear Experts,

Ours is an establishment covered under shops and establishments act.  We have certain doubts between Gratuity payment and payment of accumulated earned leave as the calculation of eligible number of days in both the acts is more or less equal and similar.

Please let me be clarified

Whether payment of Gratuity is in addition to the payment of accumulated earned leave salary under shops and establishment act.

Yes. Payment of Gratuity is in addition. The period of service is explained in the act.


Section: 2A
Continuous service.
