Full n final settlement

Dear Experts, I had given resignation to my last organisation on 29th september 2017. They said will provide you FnF after 45 Days but almost more than 70 Days completed they are not providing my salary of September month & travelling allowance . Every day they say will give you today , tomorrow but not giving. What can I do against company for releasing my dues..... please help.

While posting such queries employee should post basic information!

What is this establishment; Commercial, Industrial?

What is its nature of business say; IT, ITeS?

How many persons are employed in it?

What is your designation and nature of duties?

How many persons report to you?

Do you have any power to sanction leave/increment/appoint/terminate/appraise etc etc ?

You are in which state? Since how many months you are working? Are you under probation period or your service is confirmed in writing?

Does offer/appointment letter/contract of employment state that notice pay in lieu of notice period is not accepted?

Do standing orders (model/certified) apply to establishment and your designation?

What is notice period as per appointment letter/offer letter and what was notice period tendered by you?

Was ever any stinker, memo, show cause notice on any misconduct issued to you?

Does the establishment have its appraisal system? Do you have copy of signed appraisal forms, matrix, KRA’s, performance date? How was your performance?

Are you a member of employee’s/trade unions?

Has the establishment issued/supplied, offer letter, appointment letter, salary slips of all months, PF number and a/c slips of all years, ESIC card, correct FnF statement, Form 16 as per correct FnF statement, acknowledgment and acceptance of notice of resignation/final resignation, acknowledgment of handover of charge, NOC/NDC……………?

Saying, telling, asking etc are verbal mode of communication  and difficult to establish.

Is there any calsue in appointment letter or any other rules/policy etc that FnF settlement shall be paid after 45 days from LWD?

Respected sir/mam I resigned from previous organization after serving period they have provide me reliving letter and after 20day I got my FNF but it has passed 55 day after leaving the organisation but didn't receive my pending salary what should I do . When I talk to hr . She say u will your salary But when he don't know.

Dear LCI Querist @ Mr. Ramesh,

 

Talked, talking, saying, asking are all verbal modes of communication and difficult to prove.

Write under proper acknowledgment and narrate all representations in brief and ask why payment of FnF dues is not paid to you and when it shall be paid.

Have you checked that FnF statement is correct and contains correct computation of earned wages/OT/Leave encashment/bonus/incentives/Gratuity etc etc  and an amount is to be paid to you?

In case of delay employer is liable to pay interest.
