Family partition settlement

Dear sir,

My father was in joint family along with his 2 brothers (my father + 2 of his brothers) and did first family partition settlement during year 1999. But two properties were not included in the partition settlement, as there was no value those lands. These lands were left as it is (around 2 acres) and it is/was under my father’s name. April 2014 my father died and value of the lands gone up in course of time. My Fathers brothers ask for their part and looks like we need to divide the land now.

1. These lands which were not divided during 1999 to my father's brothers, how can we divide them now for my father's 2 of his brothers?

2. Do we (I+ brother+ sister) need to have property registered to our names to divide my father’s property between us?

1. Before partion all lands belongs to your grandfather.

 

2. How can your father get registered the undivided land on his own name without any wish of your two uncles.

 

3. Now the land which has gone at high rate will be divided equally into three shares one for your deceased fathers heirs-1schedule and rest to both of your uncle individually.

 

4. The ancestoral shares cant be sold priror to partion suit of separation.

 

5. You and your brother sisters have equall shares In your deceased fathers ancestoral shares.

 

6. Yes. Again the partition suit of separation and registration of each shares Is needed among your brothers ans sisters when it comes under the matter of ancestoral property from the deceased fathers share.

 

7. Provided that daughters right in ancestoral property with the hindu succession amendment act 2005 r/w sec.6
