Drunk driving

Hi, My friend is caught in drink and drive for the 2nd time in Mumbai. The police who caught did not ask him if he was caught before. He has to be preset in court tomorrow and he doesn't know if the judge knows this is his 1st time for 2nd time. Is there any possibility to that the judge will find out that this is his 2nd time?? Plz its a little urgent to know. Will it okay if he doesn't mention it to anyone?
