Division of poperty between brothers

Dear Sir, I have a query regarding property distribution among brothers. The situation is that my grandfather had two sons and grand parents are not alive in present. And five years back my father passed away, at that time I was very young and my uncle (taya) has acquired more land (road side front area) without mine and my mother's consent. He has constructed shops over that land. It is possible to take that land in return or to demolish the construction over ours portion. So that frontal area will be distributed equally. It is believed that you are Hindu and your Grandfather has not left any WILL and it was self acquired proeprty.

The property shall devolve equally upon two brothers.Your father's share shall devolve upon your mother,you and your brothers/sisters.

 

You can approach a lawyer specailizing in property/family/civil matters and try for amicable family settlement deed (registered) and if it is not possible file for partition suit.

if your grandfather had died intestate then both his sons will get equal share along with their mother in the property.file a partition suit to claim your rightful share if you are not able to arrive at a family settlement
