Delay in registration of trademark

Dear All,

1. we applied for registration of certain trademarks for which online status is showing accepted and advertised. Now three months period of objection is lapsed in 2013. Howevre, we have not yet received certificate of registration. please advise what can be done to fasten procedure and get registration certificate.

2. We, suo moto, submitted replies to trademark registry for online examination report though we have not received notice from trademark registry to that effect. We have not received any other further communication from Registry regarding hearing or further reply.please advise what can be done to fasten procedure and get registration certificate.

Hello,

With respect to your first query about your mark being advertised but not yet registered, please note that it is not unusual. The Registry does take a long time before issuing the RC to avoid unnecessary issues by third parties. As you state that the opposition period has elapsed, my recommendation would be to visit the Trade Marks Office and consult with them.

For the second query, please check the online Registry website for the hearing lists for every month. They are usually uploaded in the last week of every month. Check if your mark finds a mention there because sometimes the Registry does not send notices. Also, see if you can visit the TMO.
