Contrary single bench judge

Please suggest me which sections/provision/Caselaws would apply to the following

-Where a Single bench judge of an high Court passed a Judgment contrary to a a judgement passed by another single bench Judge in a similar case with similar facts. 

(My view suggest that the Judge on finding it contrary to his views should have reffered it to the Divisional bench of the High court).
