cheque bounced 9 months back

Builder given me pcs cheque of 9 lacks against the cancellation of flat and got bounced 9 months back ,informed the builder about the cheque bounce and he had promised me that he will give another new flat ,but still now he had not kept his promise .what should I do now ?original sale agreement and bounced cheque is with me.this builder is a very criminal minded person .please suggest me to get back my hard earned Money from this builder.
