Case under ipc 199,200 in a matrimonial case

Hi All experts,

We have applied for divorce in Aug 2015  and currently our case is in evidence and argument phase.

We came to observe that , my wife has filed false statements while filing her say and while filing application for maintenance. We have produced all required docuemnts/ evidences which clealy falsify all her allegations.

So wanted to know with the experts on this forum , whether we can file case on her under section IPC 199, 200 for the details which she had submitted before hon, courts which are pretended to be true but in fact are false in nature.

Thanks in advance !

IPC 191, 193, 199, 299, 196 slightly differ from each other, but are the same.  Here what you need to understand is repurcussion of filing such case.  You fail to prove that she lied under oath, then you will easily go behind bars + will have  to pay fine like Subramaniam Swamy did in Ram Jhetmalani case.

In civil matters cases go on snail speed.  Though result is gauranteed, you will have to wait for long periods to come out of cases.  Start is gauranteed.  End of case is also gauranteed, but when? That nobody can tell and if you fail to prove charges or allegations, you will also do time behind bars.

Its always better to settle matter amicably than simply pulling each other hair.  Finally nothing will be left in hand, except hair.

The Courts in our country are rather lackadaisical towards offences towards justice. The tainted witness box is the organic disorder that is haunting our judicial system.

Thanks all for your kind reply and suggestion...why I asked this question was because , there is no fear of our judiciary to the people..they can say so many lies on oath before court and does not have any seriousness ..As a result so many innocents are just running on the court dates and without any outcome but just the frustration.
