I had an road accident. I was on car and the other person was on scooter. he hit my car and fall from scooter (he was on wrong side on a road with proper divider). He got fracture on his one leg. He filed a case against me for rash driving. My all papers(DL,RC of car and Insurance) are correct but that person's driving licence was expired 3 years back.. but now every body is saying that in an accident case, fault is always considered of bigger vehicle in any condition. Kindly guide.. Is it my only fault that i am on car and other one was on scooter???? the person who is on smaller vehicle(without valid DL) may also be guilty.. Kindly help.
