As per the directives under 330/2007, the IO has to seek permission from the DCP/ACP before arresting an accused in 498a. In an RTI application, I asked for the authorisation letter from DCP from the IO who said it has been submitted alongwith the chargesheet. I have a photocopied set of the chargesheet, and it is not there in it.
I would like to seek some information from those who have been chargesheeted u/s 498a by the Delhi Police if they have been given a copy of this authorisation letter ? Is it a separate letter? Or is it just some signature on one of the several pages of the main charge-sheet copy?
