Property issue.

Dear Lawyer Friends..

The property is in the name of my grandfather and he was expired in the 1979, and propety is still on his name and no death cerificate was obtain for local body office / corporation or no record are availiabe of death in the hospital ( LTMH - Sion Hospital ), so the property cannot be trasfred on my dads name . As the property tax and electricity and water bill are paid by my dad.

Need to know is there any option to transfer this propety on my dad's name by any law or by preparing any deed

Please help...!

Dear Lawyers Friend

The Property of my Dad (Saeed Guest House) BMC is Landlord. There are Two Names in Rent Receit

1. My Fathers Brother 2. My Fathers Brother but this Hotel is run by my father from 40 decades all rent, electric bills, water bills, professional tax are paid by my father.

Now in 2011 My Fathers Brother Son came to know that his fathers name is there in rent receit of the property. He filed a Suit in Bombay City Civil Court about the possession of the property. The Judge dismiss his stay order and Chamber Summon after that he withdraw the case.

Sir My Question is if he filed the suit for share in the hotel will he get it.

He is my step brother his father had died in 24/06/1989 more than 23yrs now his trying to grab our property. only his fathers name is in rent receit. Electricity bill is on my fathers name, Ration card is on my fathers name. The 2. my fathers brother name in the rent receit share has taken by us from them.

This is adddressed to Deepak vedpathak,

You have not cleared that whether the property is open land or independant house or flat. Anyway, on the death of the owner of the property, the legal rights will devolve on the legal heirs. There is no necessity for any registered document.  The only thing is you have to do mutation of the names of legal heirs. Even without mutation also the legal heirs can sell the property to third parties through regd. sale deed.  The mutation can be done later.
