Presence of petitioner's advocate

Hi all,

In DVC Case, the respondent has filed rw2. Iam the petitioner. Can anyone guide me, at the stage of marking, can respondent get his evidence marked in absence of my advocate?

marking can be done in the abesence of an advocate, but advocate presence is necessary.

as per my opinion

if any marking is done in the absence of the oposit parties advocate and both the parties is present before the court then the party whose advocate is absent have right to raise objection at that time, if the party raise objection.

Dear All,

It is settled law and procedure mentioned in Cr.P.C that evidence cannot be led in absence of accused. it is nowhere mentioned about the presence of advocate. but now a days it is the procedure adopted by the court in absence of advocate of accused no evidence is led.
