Passport suppression information

Dear All, I need an advice for the following problem. My friend had applied for a passport at the Passport office when he was a minor in 2005 when there was a criminal case pending in the court and when the documents came for verification to the local police station the police sent the information of the same to the passport office and the SCN was issued to him, which he dint reply to and later he applied for passport from another passport office and got the passport issued by suppressing the information of his pending case. He got the passport issued in 2005 and for his good luck his case was also disposed off and he was acquitted in the case in 2007. And there is no more any case pending against him and all record is clear. Now recently his passport expired and he applied for renewal and when he visited the PSK he was informed that he had suppressed some information in 2005 and it had a adverse remark and was asked to pay fine of Rs1000/-. So now since his case is dissolved and he is acquitted in 2007 will he be still prosecuted for suppressing information in 2005 or since the case is dissolved he will get away with the legal action of passport authority ?? Dear Rudra,

suppression of material fact is still there, that is not related with the result of the case but he was supposed to disclose the facts, hence liable to pay the fine.

Dear sir thanks for replying. So is it just the fine or prosecution too?? Since the passport was not issued and case was closed at the PSK where the SCN was issued in 2005.
