New rent control act of tamilnadu

Hi, I am letting out a commercial property for rent. This is 36 months rental agreement. I am getting different direction with respect to registration. One advocate is saying that this needs to be registered with the sub-registrar paying 1% of the rental value + security deposit as the stamp duty and then with the rent control authority. While the other advocate is saying this needs to be registered only with the rent control authority paying a registration fee of 1% of the rental value or Rs 25,000 which ever is less. It would be helpful if someone can throw some light into the registration requirement and the stamp duty and registration charges. Thanking in advance.

The stamp duty applicable on the rent agreements in Tamil Nadu, for a period of up to 30 years, is 1% of the rent plus the deposit amount. Apart from stamp duty, registration charges in Chennai are around 1%, with a maximum ceiling of Rs 20,000.

The stamp duty applicable on rental agreements in Tamil Nadu is 1% of the rental value + the deposit amount.  This is applicable for rental period of upto 30 years.

The appropriate Stamp Duty in tamil nadu is 7% of the market value + the security deposit and the registration charges is 4% of the property value which is applicable up to 30 years. Try getting these things done online as their are sites which are reliable and who provide good and affordable services.

The Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 is the new Rent Control Act in Tamil Nadu. It aims to balance the rights of landlords and tenants by:

  • Replacing the outdated Tamil Nadu Buildings (Lease and Rent Control) Act, 1960

  • Mandating written rental agreements

  • Introducing rent authority, rent court, and rent tribunal for dispute resolution

  • Allowing market-driven rent and fixed tenancy terms

  • Making registration of tenancy mandatory

This Act promotes transparency and protects both parties in rental arrangements.
