Consumer forum execution

anyone knows the execution process for a consumer court order ?

if someone is not obeying consumer court order, 

1) can consumer judge issue arrest warrant ?

2) if consumer judge issue arrest warrant, will that arrest be criminal or civil in nature ?

When a party fails to comply with an order of the Consumer Forum, the aggrieved consumer may initiate execution proceedings under Section 71 of the Consumer Protection Act, 2019, which empowers the Forum to enforce its orders in the same manner as a decree of a civil court. In the course of execution, the Forum may direct attachment of property, recovery of the decretal amount as arrears of land revenue through the District Collector, or impose penalties for continued non-compliance. Further, under Section 72, wilful disobedience of a Consumer Forum order amounts to an offence punishable with imprisonment up to three years, or with fine, or with both. In such cases, the Forum may issue a warrant of arrest, but the proceedings are treated as quasi-criminal in nature since they stem from contempt or disobedience of a statutory order, not from the original consumer dispute itself. Thus, while the arrest is not akin to a conviction for a substantive crime, it does carry penal consequences for default in obeying a judicial directive.

If a respondent fails to comply with a consumer court order even after an execution petition is filed, the court can take further actions to enforce the decree, including attachment and sale of property, arrest and detention, recovery as arrears of land revenue, garnishee proceedings, or contempt of court proceedings. 

If the decree involves a monetary award, the court can direct the District Collector to recover the amount as arrears of land revenue. 

Deliberate non-compliance with the consumer court's order can be treated as contempt of court, leading to penalties like fines or imprisonment. 

The specific course of action will depend on the nature of the decree, the respondent's conduct, and the court's assessment of the situation.
